  • Definition:
    • Drav Telecommunications PVT Ltd is hereafter referred to as ‘U2Call’.
    • The person or company opening an account is ‘the customer’. These Terms and Conditions bind the customer whether an account is opened by completing a written application form or by requesting an account over the telephone or internet and comprise the contract between U2Call and the customer.
    • U2Call provides a Personal Identification Number (PIN) to the customer.
    • Account Number’ means a number issued by U2Call to the customer for use of the account service.
    • 'Service’ refers to the U2Call Account service. ‘Rates’ refers to the tariff charges made for calls and which are available upon request and are inclusive of Taxes.

  • Service:
    • The U2Call Account Service will enable the customer to make telephone calls from and to nominated countries at rates, which may be changed at any time without notice and up to the value of credit remaining on the account of the customer.
    • U2Call will ensure that all reasonable care and skill is used to provide the customer with a high quality and continued service. U2Call will endeavour to resolve any disruptions to the service as is reasonably possible within its control.
    • The customer undertakes to use the service in accordance with U2Call’s written instructions as may be given from time to time.
    • The customer undertakes not to use the service to send a communication, which is offensive, obscene, or indecent which, may cause inconvenience or anxiety to anyone or that is prohibited by law.
    • The customer is responsible for all costs incurred as a result of loss or unauthorised use howsoever caused until U2Call has been given sufficient time to deactivate the PIN number or change CLI number/s.
    • U2Call will issue the PIN/CLI number/s only to the original applicant for the account service and reserves the right to issue the number only verbally.
    • In the event that the customer requests written confirmation of the PIN/CLI number/s U2Call will not be liable for loss or subsequent fraudulent misuse of the PIN/CLI number/s. Under these circumstances the customer is liable for all costs incurred.
    • U2Call reserves the right to transfer or assign all or part of this contract to another person.
    • The customer undertakes not to use or attempt to use the account service following termination of this agreement once notification is provided.
    • U2Call will also from time to time need to ask the customer to review and update personal information it holds, to ensure all details are correct and valid.
  • Charges and Payment:
    • U2Call will require charges for the account service to be pre-paid unless otherwise agreed. The service will not become available until payment is made and funds cleared in full. A person signing this contract on behalf of a business is assumed to have the authority to do so.
    • Credit card or cheque can make prepayment.
    • U2Call will use information provided by the customer to make all necessary credit checks for credit status for U2Call’s Post-Paid account service.
    • Post-paid account customers will be invoiced monthly in arrears.
    • Payment is due within 7 days of the date of the invoice.
    • U2Call reserve the right to charge interest on all outstanding amounts owed to U2Call and not paid in accordance with this agreement. U2Call will charge 1% interest over the prevailing Barclays base -lending rate until such time as the outstanding balance is paid and regardless of whether the service has been terminated.
    • The customer is liable for all costs incurred by anyone using their assigned PIN number. Call charges will be deducted from the account as calls are made.
    • Call charges will be calculated in accordance with U2Call’s tariff from time to time in force, which are available on request from U2Call.
    • The customer shall not be responsible for charges arising from Calls after U2Call has received notification of termination loss or theft.
    • In the event of inactivity for a period of consecutive 6 months, Account will be made dormant.
  • Misuse of PIN/CLI number:
    • The user is responsible for reporting immediately to U2Call any loss, suspected unauthorised use or disclosure of the PIN number, or access to the service through the use of programmed CLI number/s. The customer agrees that U2Call will disclose any information in connection with your account to anyone who correctly quotes your password.
  • Termination of the Service:
    • U2Call or the customer/user may terminate the service at any time by giving at least 7 days written notice to the other party.
    • The customer/user will be liable for all charges incurred up to the expiry of the notice period.
    • U2Call may suspend the service if the customer / user is in breach of this contract or if it has reason to believe that the account is subject to misuse.
    • U2Call reserves the right to make an administration charge.
    • Termination of this agreement will be without prejudice to the rights and obligations of the parties.
  • Service of Notice:
    • Drav Telecommunications PVT Ltd is registered in India. Operating office address: No 1A, BalaMuthu Krishnan Street , T.Nagar , Chennai.
  • Changes to Terms and Conditions and Charges:
    • U2Call reserves the right to alter the Terms and Conditions of this contract or the charges made for the service.
  • Exclusion of Liability:
    • U2Call shall under no circumstance be liable for the actions or equipment failures of its telecommunications service providers within or outside of its Jurisdiction in so far as they may affect the provision or suspension of any service.
    • Under no circumstances whatsoever will U2Call be liable to the customer/user for loss directly or indirectly of profits, business or anticipated savings or for any indirect or consequential loss whatsoever.
  • Force Measure:
    • U2Call shall not be liable for any breach of this contract caused by acts of God, insurrection or civil disorder, war or military operations, national or local emergency, acts or omissions of governments, highway authority or other competent authority, industrial disputes of any kind, fire, lightning, explosion, flood, subsidence, inclement weather, acts or omissions of purpose or bodies for whom U2Call is not responsible, or arising from any other cause whether similar or dissimilar outside U2Call’s control.
  • Jurisdictions:
    • If any part of this contract shall be invalid, illegal or unenforceable in any respect the validity legality and enforceability of the remaining provisions shall in no way be affected or impaired. Any dispute arising from this contract will be governed by Indian law and subject to the jurisdiction of the Indian courts.
